General Terms and Conditions (GTC)
These General Terms and Conditions (“GTC”) apply to all contracts concluded between RUBIACA® Travel, Scheidter Str. 42, 66133 Saarbrücken, Germany (“RUBIACA® Travel” or “we”), and the customer (“Client”) for travel-related services. They apply unless mandatory statutory provisions provide otherwise.

Role of RUBIACA® Travel
RUBIACA® Travel operates as a travel agency. Depending on the service booked, RUBIACA® Travel acts either as an agent arranging travel services such as flights, accommodation, transfers or excursions provided by third-party suppliers, or as an organizer of package travel where explicitly indicated. The contractual obligations of RUBIACA® Travel depend on the role specified in the booking confirmation.

Conclusion of Contract
A travel contract is concluded when the Client receives a written booking confirmation by email or other written means from RUBIACA® Travel. All offers are subject to availability and confirmation by the respective service providers.

Services and Prices
The scope of services results exclusively from the booking confirmation and the individual travel documents. Prices are based on the information available at the time of booking. Taxes, fees and surcharges imposed by third parties may change independently of RUBIACA® Travel.

Payment Terms
Unless otherwise agreed, a deposit may be required upon booking and the remaining balance is due before departure as stated in the invoice. Payment details are provided on the invoice and payments must be made without deduction.

Changes by the Client
Requests for changes after booking, including rebookings or name changes, are subject to availability and the conditions of the respective service providers. Any additional costs incurred will be borne by the Client.

Cancellation by the Client
Cancellation conditions depend on the applicable terms of the respective service provider or package travel agreement. Cancellation fees may apply and can amount to up to 100% of the travel price, particularly close to the departure date. The decisive date is the receipt of the cancellation notice by RUBIACA® Travel.

Cancellation or Changes by Service Providers
RUBIACA® Travel is not liable for changes or cancellations made by airlines, hotels or other service providers. In such cases, the applicable terms and conditions of the respective provider apply.

Travel Documents and Entry Requirements
The Client is responsible for ensuring that all required travel documents, including passports, visas and health certificates, are valid and complete. RUBIACA® Travel is not liable for denied entry or transport due to missing or invalid documents.

Liability
RUBIACA® Travel is liable only for damages caused by intentional or grossly negligent conduct, unless mandatory statutory provisions provide otherwise. For services arranged by RUBIACA® Travel and provided by third parties, liability lies exclusively with the respective service provider.

Complaints and Claims
Any defects or complaints must be reported immediately on site to the respective service provider and to RUBIACA® Travel without delay. Claims for damages must be submitted in writing within the statutory limitation periods.

Insolvency Protection (Package Travel Only)
Where RUBIACA® Travel acts as an organizer of package travel, insolvency protection is provided in accordance with applicable German law. Details will be included in the travel documents.

Data Protection
Personal data is processed exclusively in accordance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR). Further details are available in the Privacy Policy on our website.

Governing Law and Jurisdiction
German law applies to all contractual relationships. If the Client is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the place of jurisdiction is Saarbrücken, Germany.

Severability Clause
If any provision of these General Terms and Conditions is or becomes invalid, the remaining provisions shall remain unaffected.
